What is AEO and who issues it in India?

Is AEO mandatory or voluntary?
AEO is purely voluntary. However, given the cash-flow benefits of deferred duty (T2/T3), faster Bills of Entry, lower BG and global MRA recognition, most large importers / exporters and serious mid-size traders apply. It is also a strong differentiator in tenders and global supply-chain audits.
Which AEO tier should I apply for first?
Most importers / exporters start with AEO-T1 — it is desk-review based and faster (3–6 months). After 1–2 years of compliant operations on T1, an upgrade to T2 unlocks deferred duty payment & lower examination. T3 is reserved for top-tier compliant entities (after holding T2 for 2 years). Logistics service providers apply directly under AEO-LO.
What is the minimum eligibility for AEO-T1?
Applicant must (i) hold a valid IEC, (ii) have been engaged in customs activity for at least 3 financial years, (iii) have handled at least 25 import / export documents in the previous financial year, (iv) have no serious customs infringement in the last 3 years, (v) have a positive net worth and (vi) maintain proper accounting & record-keeping.
How long does AEO certification take?
Indicative end-to-end timelines (from filing): AEO-T1 — 3–6 months; AEO-T2 — 6–9 months; AEO-T3 — 9–12 months; AEO-LO — 6–12 months. Timelines depend on completeness of annexures, jurisdictional cell workload and physical-verification slot availability for T2/T3/LO.
What is deferred duty payment under AEO?
AEO-T2 and AEO-T3 importers can defer payment of customs duty: duty for goods cleared between the 1st and 15th of a month is payable by the 16th, and duty for goods cleared between the 16th and last day is payable by the 1st of the following month. This significantly improves working-capital cycles compared to upfront duty payment.
Does AEO certification waive Bank Guarantees?
Yes — but progressively. AEO-T1 holders typically get 50% reduction in BG requirement, AEO-T2 holders get 75% reduction, and AEO-T3 holders enjoy almost complete waiver of BG (subject to specific scheme provisos like EPCG, advance authorisation etc.). This frees up substantial banking limits for working capital.
What are MRAs and which countries recognise Indian AEO?
A Mutual Recognition Agreement (MRA) is a bilateral pact where two customs administrations recognise each other's AEO programmes. India has signed MRAs with South Korea, Hong Kong, Taiwan, UAE and is in advanced negotiations with the United States, the European Union, China, Japan, Australia and several ASEAN countries. Indian AEO holders enjoy expedited customs in MRA-partner countries.
Can MSMEs apply for AEO?
Yes — CBIC has introduced a simplified, document-light AEO-T1 process for MSMEs (Micro, Small & Medium Enterprises). What happens if AEO conditions are violated?
CBIC may suspend or revoke the AEO Certificate if material conditions are violated — e.g. customs offence, non-payment of duty, security breach or failure to intimate change of premises. The applicant gets a hearing opportunity. Once revoked, re-application is possible after a cooling-off period and demonstrable corrective action.
Can foreign companies / Indian subsidiaries apply for AEO?
Yes — any entity holding a valid Indian IEC can apply, including subsidiaries of foreign multinationals. Foreign holding-company structures, audited financials and overseas group security policies are accepted as evidence subject to translation & notarisation.
